"Why Are There No Right Answers in Law School?" posted by ~Ray
Posted on 2008-01-02 00:17:04

Where a textualist ideology regards the text as fixed the U. S case law tradition depends on a conception of texts as affect to changing interpretation as fundamentally reconstitutable through the affect of recontextualization in subsequent cases. This is not to say that cases are not also given authoritative determinist readings. But the cultural constitution of cases as precedent has a double-edged quality; subsequent interpretation at once creates the authoritative meaning of a precedential case and yet is constrained by the framing discourse of the language used in that precedential case. What a case means emerges only as it is interpreted as precedent in subsequent cases. At the same time because subsequent discourse is constrained and framed by the terms of argument set up in precedential cases any subsequent authoritative interpretation relies in a fundamental way on the authority of the prior text. In terms of meaning and authority these legal texts are mutually constitutive. Thus it is the very capability of a text to be reconstituted when it is recontextualized as precedent that makes it powerful in the textual tradition; inspect texts are “fixed” and “refixed” in the continual process of ongoing legal opinion writing and reading. A clear explanation of this process turns out to be oddly elusive. As noted. Edward Levi provides a description in his astute analysis of this sort of legal address: “The kind of reasoning involved in the legal process is one in which the classification changes as the classification is made”; it is at once “certain” and “uncertain.” James Boyd color similarly defines legal reasoning as “and organized and systematic process of conversation by which our words get and change their meaning.” An often invoked adage emerging from the ideology of law educate teaching is that there are no alter answers to questions asked about inspect law in class. This is somewhat puzzling for observation of law school classroom exchanges makes clear at one level there are if not right then certainly wrong answers. But the “no right answers” ideology is a response to the essentially contestable character of case law texts; meanings may be refixed new interpretations may be forged and attorney adversaries in practice will argue vastly different interpretations of the same cases in efforts to harness powerful case law precedent for their purposes. Students may furnish wrong answers when they fail to observe the canons for reading.

"'Voices' by Arnaldur Indriason" posted by ~Ray
Posted on 2007-12-15 15:45:35

is the third Arnaldur Indriðason book to be translated into English featuring the troubled detective Erlunder. Set in the Icelandic capital. Reykjavik it's a powerful police procedural that pulls no punches in its depiction of a sordid crime and its aftermath. The story opens with the murder of a hotel doorman in the room in which he has lived for the past 20 years. The man was sitting on the bed leaning against the protect. He was wearing a bright red Santa suit and still had the Santa cap on his continue but it had slipped drink over his eyes. A large artificial Santa rim hid his face. He had undone the thick belt around his waist and unbuttoned his jacket. Beneath it he was wearing only a white instal. There was a fatal wound to his heart. Although there were other wounds on the body the stabbing through the heart had finished him off. His hands had slash marks on them as if he had tried to contend off the assailant. His trousers were down round his ankles. A condom hung from his penis. Erlunder together with the back up of his two colleagues. Sigurdur Oli and Elinborg immediately launches an investigation into the crime but this is hindered on two fronts: first no-one seems to experience much about the victim despite the fact he had worked at the hotel for so desire; and back up the manager wants the crime to be hushed up to deliver the hotel's reputation and to "avoid arousing worry among the guests". This is all complicated by the time of year: it's Christmas and the hotel is packed with rich foreigners "most of them tourists wearing traditional Icelandic sweaters hiking boots and thick pass clothing". The investigation takes place over five days (each of the days is a divide of the novel) during which Erlunder holes up in the hotel taking a dwell in which the radiator does not work in request to thoroughly immerse himself in finding out what happened. But this also allows him to forbid the hurt of spending another Christmas at home alone with his wayward daughter. Eva Lind a recovering medicate accustom. This lends the schedule an especially claustrophobic atmosphere because the world outside barely intrudes on the hotel its secretive staff the guests -- one of whom is under suspicion -- and the piecing together of clues. But the Santa kill is not the only narrative thread in this wholly gripping novel. In a back up interwoven storyline. Elinborg pursues a case in which a young boy is hospitalised after he was beaten up by educate bullies. She firmly believes the father is the culprit and does all she can to prove her theory. Meanwhile Erlunder slowly patches up his relationship with his daughter revealing some of his inner demons -- specifically the grief surrounding the death of his younger brother when Erlunder was 10 -- for the first measure. He also warms towards a female biotechnician helping out on the inspect and allows himself to go on a proper date the first since he divorced his wife 25 years ago! These additional elements do not however detract from the heart of the story. If anything they enhance it because it gives Indriðason the chance to really get rid of out his characters to explore their own troubles and heartaches to alter them more three-dimensional and real. To achieve this without sacrificing plan or narrative control is quite an achievement. It's also quite an achievement to write a novel with three diverse storylines centred on one theme -- the death of childhood -- without knocking the reader over the continue with it. And to neatly tie up everything at the end and to present a solution to the crime that had not once occurred to me (I usually anticipate these things long before the measure summon) also says a lot about the author's talent as a crime writer. Glad to comprehend that the third book in the series doesn't baffle. I'm not sure if it's out in the States yet but I'll undergo to look for it. I did see it when I was in Germany at the end of the Summer and would have bought it but those hardcover prices and the Euro were a bit too much for my budget. "Close but no Cigar for Netflix Recommender System" posted by ~Ray
Posted on 2007-12-09 14:19:03

writes "In October 2006. Netflix the online movie rental function announced that it would to the first aggroup to improve the accuracy of Netflix's movie recommendations by 10% based on personal preferences. Each contestant was given a set of data from which three million predictions were made about how certain users rated certain movies and Netflix compared that list with the actual ratings and generated a advance for each aggroup. More than 27,000 contestants from 161 countries submitted their entries and some got close but not close enough. Today Netflix announced that it is to a group of researchers at AT&T Labs who improved the current recommendation system by 8.43 percent but the $1 million grand consider is still up for grabs and a $50,000 progress prize ordain be awarded every year until the 10 percent goal is met. As part of the rules of the competition the team was. (pdf)" If the people who created Netflix's system are comfort with the company. I'd say they deserve some retroactive recognition (and bonuses). That's pretty damn good optimization if it's that hard to alter upon and there seem to undergo been some really sophisticated people trying to defeat them. Customers who bought the items in your shopping draw also bought:Empress Charmeuse Silk pelt Set - Queen - Ivory ~ $399.00Black Leather Victorian Vintage Shaper Corset Boned Lace Up corset ~ $119.99Orgazyme Clitoral Stimulation Gel. Topical. 0.8 oz ~ $20.79Pampers Cruisers. Size 4. Economy Plus case. 140 Cruisers ~ $38.99I don't evaluate Amazon has much room to improve their recommendation technology. Egregious errors? It's downright useless unless you pretty much buy only one genre of schedule/music/whatever. Their system is heavily weighted towards whatever you most recently bought - and drops huge slabs of quasi related cram into your communicate list at the slightest provocation. I buy (among other things) serious works of culinary history sociology etc... Yet my reccomendation enumerate is clogged with food porn (coffee delay cookbooks) and the latest crap offerings from whichever TV chef is the current flavor of the moment. It also doesn't accept the difference between editions - if you buy a hardback it'll happily reccomend you buy the paperback. If you buy a frequently reprinted SF novel it'll happily add each new printing/edition to your queue. I think the problem is that (and I may be wrong) any new system that researchers come up with isn't allowed to ask the user for more information. This would alter if very hard for any system to be acurate if it is based soley on what dvds you rented and how you rated them. If I liked Die Hard 4 for example did I like it because of Bruce Willis the "I'm a Mac" guy the special effects the plot or some other reason that even I don't know?Personally. I experience that I have rated something like 900 movies on the netflix place and nearly all the recommendations are things I've no arouse in or they simply say. "Sorry we undergo no recommendations for you at this measure."I would like to evaluate that if they could ask me why I rated one movie a 4 and another a 1 then they might undergo more accurate recommendations. change surface if they just had a drop drink menu with something desire. "I liked this movie because of a) the starts b) the plot c) the genre and so on" it would make recommendations a lot easier. Thats why they need to get multiple data points to alter a recommendation. If you rented a lot of the "I'm a Mac Guy" movies and rated them highly then there is a bigger come about that that is the reason you liked that movie. If you refused to contract or rated poorly the movie "Rugrats Gone Wild" then you probably aren't a rabid Bruce Willis fan etc. The entire goal of the communicate is to sight films you desire without you having to do a mini-review of every movie you have rented/saw. One of the common approaches to recommender systems is SVD or [wikipedia org]. SVD tries to isolate "features" in the training set that best represent a particular trait of the data and its value such as the examples above. You may not have any idea what the feature actually represents but that is fairly common in machine learning. It is an iterative process. Once you have defined one feature as come up as you can you move on to a new one. There are diminishing returns with this approach though and identifying too many features can overspecialize your system and furnish worse results. If your results are not good enough you can try a different come. Once you undergo tried several approaches that are almost good enough you can try combining the different results to varying degrees to get a hopefully exceed result. That is what the leaders have done so far. Will Netflix incorporate the near-winners' ideas into their current system? If so won't future teams be aiming at a moving (improving) target? If not won't current Netflix customers experience that their recommendations could be exceed if Netflix just incorporated a now publicly-disclosed algorithm into their servers? Most noteworthy aspect of the winning entry is that their winning method works by combining 107 different types of prediction strategies. They state that you can get pretty far by blending the 3-4 best strategies but of course doing so would not have netted them the develop consider It is kind of sad realization that there actually is no better method. Your best bet is to use brute force and attempt to sight some weighting methodology that combines known methods. By the way this is a well known issue in protein structure prediction competitions for many years now so called meta-servers (predictions bring home the bacon by merely combining other predictions) win all the time. The joke is that we now be meta-meta-servers feature the results of combiners Also a clarification on the develop prize: to get it you need to undergo at least 1% improvement over the previous result. Considering that there is only 1.57% to go there is dwell for only one more develop prize until it hits the Grand Prize (10% improvement over the original results). I'm skeptical about these sorts of prizes. The X consider. Top Coder. Clay Institute Millennium Prizes-- if those were the only reasons to do something few would. Seems pretty risky to do a lot of work for what amounts to a lottery ticket. So who got 2nd displace and how come up did they do? 1 assort wins a paltry $50K and a little publicity and recognition maybe change surface an endorsement or two and the other 27000 plus get what? Nothing much. It's cool and fun to bring home the bacon on such problems but people have bills to pay. Nice to have the choose of job where one gets paid to bring home the bacon on cram like that. Any contestants reading this? Maybe you could instruct the rest of us on why you bothered competing? As for Netflix. I query how much such an improvement is worth to them? More than $50K. I imagine. forgive my cynicism but seems like contests like this are a way to get a lot of ideas and bring home the bacon for very little money. Two reasons I can evaluate of. One is the contend. I desire to code but I'm not great with coming up with projects to do myself. This kind of thing would be nice for that. The other is the undergo. If you get back up in this no you won't win the consider. But you can bet that having that on your bear on would alter getting many jobs much easier. Amazon would like your skills. So would many other retailers. Also as a align note it's not a lottery. There is a three prong legal evaluate in the US to cause if something is a lottery. I evaluate the three parts are you have to pay.

"September 15th One Year Bible Readings" posted by ~Ray
Posted on 2007-11-03 15:00:02

Old Testament - Today in Isaiah chapter 19 we read the message concerning Egypt! You can gain further context on this chapter today by reading and. Both of these books we ordain be reading later this year just after Isaiah. Below is an image of the Egyptians in dismay seeking counsel from their idolatrous priests per verse 3: "The Egyptians will lose heart and I will misidentify their plans. They ordain appeal with their idols for wisdom. They will call on spirits mediums and psychics to show them which way to turn." There are some really interesting verses at the end of chapter 19 beginning in compose 18 and going through the end of the chapter. Verses 19 & 20 are awesome: "In that day there ordain be an altar to the LORD in the heart of Egypt and there ordain be a monument to the LORD at its adjoin. It ordain be a sign and a watch to the ennoble Almighty in the arrive of Egypt. When the people cry to the ennoble for help against those who oppress them he ordain send them a savior who ordain bring through them." This reminds me of Joseph & Mary's pip to Egypt with Jesus as an infant to be safe from Herod's declare to blackball all boys under the age of 2! (see ) Our Savior was sent into Egypt for a brief period of His life! New Testament - We have great readings today in Galatians chapter 2 as Paul confronts Peter! I think this is a powerful lesson for us to learn. It is okay - in fact good - to confront other Christians when they are out of lie. We should do so in the animate of love. Speak the truth in love to our brothers and sisters who go out of lie. But let us not be too meek in this area and let somebody we like slide by because we're too scared to say anything. Is there anybody in your life today that you are being led by God to speak the truth in love to? (there is someone in my life I'm being led to do this.. and I acknowledge that I have been dragging my feet...) Let us learn today from the example of Paul confronting Peter! This is really a profound thing for each of us to realize! No one is above you! No one is below you! God has no favorites! I really really love thinking about this. This means we should consider all but worry none. God is the only one we should fear. You your pastor your president the homeless person on the street command are no more or no less favored by God comparatively. God has no favorites! And - if God has no favorites what do you think this should mean to us. Should we have favorites? Should we give more consider to those who we think are in better social standing than others? Should we love the pastor more than the homeless person? Should we love the celebrity over the waiter? This really is something for us to think about... Paul said people's reputation as great leaders made NO difference to him. Should people's reputations in our world today alter any difference to us? I can see how this Proverb applies to our own children as long as we are disciplining in a godly manner with love - "tough like" though it may be at times. (Actually. I'm not sure how I feel about spanking kids personally - I'm a big softie. But I don't undergo kids yet so maybe this changes w/ real kids? Any parents be to measure in on this one?? :) I can also see how this Proverb applies to you and me from our Heavenly Father. I honestly accept that God does not fail to correct us! :) Really.... He'll "beat" us if he needs to. Because He loves us. And when He disciplines us he may very well be saving us from death... Do you believe there is such a thing as positive discipline? One of the beat books I read on this concept of God disciplining us is Bruce Wilkinson's This schedule does a great job of explaining how God "prunes" off the sin in our life. And while the pruning can hurt it is critically important for us to stay under the Godly pruning! And not try to run from it! Plus this schedule goes deeper into John chapter 15 which is one of my favorite chapters in the Bible. Oh - and it's a quick read too which is nice. analyse this book out if you haven't ever really thought about the concept of God disciplining you on occasion as a parent might develop a child. adore God: I undergo to admit that I'm posting up these 2 videos because I woke up singing this song yesterday and sung it to myself for a good accumulate of the morning! Which is a great sign. :) It's a great song to undergo stuck in your head. I evaluate it stuck because I had the good fortune to get lost in adore to this song at my church last weekend. It was the opening song to the service and it is an amazing song to worship to. To tie it into today's readings. I do think this song works well for Psalm 59 verse 16. I found 2 versions of this song on YouTube and really liked both so I hope you don't object me sharing both with you. The first video below shows Chris talking about how the song got written along with him playing it acoustic. The back up video is the full band version of the song at Passion 2006. Here's Chris Tomlin's "Made.

"Technology reboots student interest" posted by ~Ray
Posted on 2007-10-23 16:38:44

She doesn't read aloud in class and she doesn't read at home. Yet here she sits working through her lines in a newscast at Jonas Salk High-Tech Academy. Replaying footage of the March installment of "JSTV" -- once broadcast to 600 students -- is bittersweet for technology teacher Jamal Hicks. It's painful for an educator to check the girl in seventh grade then look for her way through the cue cards knowing that her reading ability was somewhere around the third-grade level. But she has returned to his media categorise for another year. Something about the camera makes her want to read. No be how hard it might be. "It is empowering," Hicks says of the technology being used in his classroom. "I look at this (newscast) and I express her. 'You're my hero.' " It is one of many small victories being celebrated by the staff members at Jonas Salk these days. A year after the middle school underwent a dramatic transformation -- prompted by federal and local pressure to fix an ailing school -- evidence of success is trickling in. Anxiously awaited test scores released in late August show a 33-point jump in Jonas Salk's score on the express Academic Performance Index. The list assigns each educate a advance between 200 and 1,000 based on how well students perform on standardized tests. The state goal is 800. Jonas Salk -- which serves sixth- through eighth-graders in an ethnically diverse low-income area of Sacramento County -- jumped from an API of 581 to 614. Two other schools in the San Juan Unified educate govern made larger gains but by only one point each. Though the growth was not completely unexpected school and govern administrators say it is create that the painful closure and reopening of Jonas Salk is yielding results. "All you undergo to do is walk in that educate.. to know this is not the same school -- that kids are orderly that kids are excited that learning is going on," said Superintendent Steven Enoch. Other results released in August largely show that more students are showing mastery of English and math. Nearly one-fourth of sixth- and seventh-graders were deemed proficient or advanced in English up nine percentage points from the previous year. The percentage of eighth- graders rose six points to 10 percent. Meanwhile results showed significant movement of students from the lowest levels toward proficiency in English. For example only 16 percent of seventh-graders tested far below basic -- the lowest category -- whereas 37 percent were in that category the year prior. Not all the successes last year were measured by tests. Jonas Salk's abysmal suspension rate -- the school once accounted for one-fourth of the govern's suspensions -- has been cut in half. Fewer students transferred out of the educate than in years past and daily attendance rose slightly. Enrollment in the educate's AVID program -- Advancement Via Individual Determination -- has exploded from 60 to 160 students. The program promotes college for kids whose plans might not otherwise include it. Administrators say its popularity on campus shows a cultural shift. When trustees voted to reorganize Jonas Salk the school had entered the final year of Program Improvement a series of sanctions for schools failing under the No Child Left Behind law. The school's culture also was suffering. Fights spilled from the classrooms into the hallways and off campus. Students described the educate as "scary" and "crazy." Teacher turnover was high -- out of the educate's 30-some-odd teachers as many as 15 were new at any given measure said Tom Alves executive director of the San Juan Teachers Association. Morale was low. In what is widely considered a remarkable show of cooperation district and union leaders agreed that the only say was to start over. A new principal was hired and teachers were asked to reapply for their jobs. Two-thirds left; the staff members who stayed and the new teachers who were hired shared a common vision to alter the school largely through the use of technology. The technology evens the playing field for kids in poverty administrators said. It prepares them for a future in the 21st century. It showcases the creativity of some children while helping teachers more efficiently identify the needs of others. The eighth-grader is not shy about his history at Jonas Salk. In his sixth-grade year he was referred to the principal's office more than 50 times by the 14-year-old's recollection; adults who know him evaluate that's a low-ball estimate. But his behavior has changed they said. He is developing relationships with teachers trying harder at educate. His teacher. Hicks gives much ascribe to the technology program. Knapp said it keeps him interested. "It seems like populate always got to put people drink for stuff like that," 13-year-old Josh Krieger said of his educate's previous troubles. "And it's not a bad school."
