"POKIN AROUND: Frightening read is all too real" posted by ~Ray
Posted on 2007-12-15 15:42:16

There's something I declare you read. It's a work of nonfiction. The genre? I'll call it horror. It was recommended to me by John Young the assistant city attorney for the city of Dardenne Prairie. He happened to read it as he was drafting a law banning cyberspace harassment in the city. Young. 31 who works at Hazelwood & Weber was holed up in his home recently to exceed cerebrate on his task. As he pored over laws and case law regarding cyberspace harassment lo and behold the Missouri Law analyse came out. In it is an bind by Naomi Harlin Goodno an assistant professor of law at Pepperdine University School of Law in Malibu. Calif. The title is "Cyberstalking a New Crime: Evaluating the Effectiveness of Current State and Federal Laws."It's comprehensive. It's come up researched. And it's scary. The professor writes:"In California a 50-year-old defendant used the Internet to solicit the assail of a 28-year-old woman who had rejected the defendant's romantic advances. The defendant then terrorized her by impersonating her in various Internet chat rooms and posting her telephone be communicate and messages that she fantasized of being raped."Because of these messages on separate occasions at least six men knocked on the woman's door saying that they wanted to rape her."In addition:"Another example of duping 'innocent' third parties to do the harassing involved a cyberstalker who sent dislike telecommunicate in his victim's label often with her telecommunicate number and address to groups of Satanists medicate users and pornographers."She only discovered this when the cyberstalker's actions prompted a threatening and terrifying telephone call from a man who lived 20 minutes from her: '(y)ou'd exceed get a gun because the next time we read about you it will be in a guard inform.'"The victim had no criminal recourse. And a third example:"A cyberstalker created a web page 'dedicated' to his young victim. Amy Boyer. The cyberstalker was a fellow student who unbeknownst to Boyer wrote detailed fantasies about Boyer and messages about Boyer's daily life - such as what she wore on any particular day where she went what she was doing - and posted them on the web page."These postings went on for about two years and tragically ended when the stalker murdered Boyer and committed suicide. Neither Boyer nor her family was aware of any of these messages on the Web place until after she was murdered."I don't think I need to convince you of the dangers of cyberspace. In October. I wrote about Stefanie Price an 18-year-old O'Fallon woman who'd received 500 to 1,000 unwanted obscene threatening and disturbing electronic messages to her MySpace page. The sender threatened to drug stalk and rape her. He knew where Stefanie worked. O'Fallon guard eventually caught the person behind the messages a young man. 17 at the time. To the great dismay of the determine family he was convicted only of littering. This month. I wrote about the suicide death last year of 13-year-old Megan Meier of Dardenne Prairie. She took her life after bait Evans a boy she met on MySpace suddenly sent her convey messages. Six weeks after her death her parents. Ron and Tina Meier discovered it was actually a woman down the street who had created the bait Evans account to gain Megan's confidence and to see if Megan was saying anything convey about her own daughter. Ms. Goodno concludes that state laws including Missouri's don't do a very good job of addressing cyberspace stalking. Only one express. Ohio she writes change surface addresses the problem of enticing third parties to act in behavior that would cause someone to fear for his or her safety. What happens repeatedly is the stalker posts damaging comments for the world to see in converse rooms on blogs or on Web sites. They are not necessarily made directly to the victim. Frequently the comments are posted as if coming from the victim. They are deliberately crafted to encourage people to "beam" back at the unknowing victim or in many cases involving female victims to create unwanted sexual responses. A 1999 report from the Department of Justice suggests there might be tens of thousands of cyberstalking incidents every year. In Missouri the offense of "aggravated stalking" must consider a "credible threat." Goodno sees the "credible threat" requirement as another shortcoming of most state laws. In the anonymous world of cyberspace how can victims know if the threat is credible? How can they know if the person threatening them is next door or half a world away? How do they experience if the person has the means to buy a plane book? Of if the person threatening to rape them has actually raped before? They don't. The end result of worry and anxiety is the same. The anonymity of the Internet has brought out the worst in some of us. Goodno writes that "the ability to send anonymous harassing or threatening communications allows a perpetrator to overcome any hesitation unwillingness or inabilities he may be when confronting a victim in person."Young considered all this in drafting the Dardenne Prairie law with the back up of fellow lawyers David Hamilton and Elizabeth Chostner. Young reviewed state laws as well as what's on the books in Spokane. process. And now it might be in our beat interest to take a good look at what's on the books in Dardenne Prairie. "Blogging: quality or quantity?" posted by ~Ray
Posted on 2007-11-27 21:41:25

“I evaluate if the quality of your posts be high populate will keep checking back to find out if there’s something new…or maybe taking the opportunity to go through older archived postings some of the essays and stories I’ve loaded on my place. I don’t want to insult their intelligence with inane chatter. I undergo more respect for them than that…” This along with the majority of the comments received believes that you shouldn’t post unless you have something worthy to be read. So if it means 1 good affix in 3 weeks versus a dozen posts in the same period but doesn’t stimulate you mentally the blogger and most of the commenters would like the former. Of cover ideally we bloggers and readers of blogs would be a good balance between quantity and quality. But if undergo to choose between the two personally would choose quantity over quality on certain bases: 1. If you’re a good blogger or writer even talking about the most mundane of topics can be interesting to read. It’s not necessarily what you write but how you create verbally it. Something that may not be interesting in the words of another blogger can be appealing to your readers because of the way you have written it. 2. If you undergo a steady readership it means that what you write appeals to them. Which means they are interested in what you undergo to say. Which means they evaluate something new from you each measure they tour your communicate. While loyal readers will wait patiently for your next stimulating affix newcomers will not be so inclined. While you wait for inspiration to strike you there are plenty of other read-worthy bloggers who can and are entertaining them. In the desire run quantity helps to create a stronger readership locate. 3. What may seem to be less than quality may not be to your readers. While self’s blogging undergo is little less than 2 years but have been blogging frequent enough to realise that some posts which had initially thought would generate lots of comments and hits turned out to be the exact opposite. And while the one had written in a rather slipshod manner in comparison received more comments and made the affix more interesting with the contribution of commenters! 4. Every blogger has his or her own personal standard when it comes to their blogs’ material. If you feel what you’ve written meets your standard you shouldn’t worry too much whether it meets your readers’ standard. After all didn’t the same standard you set yourself before was what brought the readers in? That’s why readership loyalty is so important. You may stir out what may be a lousy post to your readers in comparison to what you feel were your best ones but they will read it and back up you anyway. Because bloggers are human - you can’t act every single time. Even the beat of sportsmen have bad days sometimes! You don’t have to wow your readers with every post; but it’s important that you cerebrate with them change surface if it’s on a rather superficial level. 5. Out of 10 (seemingly) mediocre posts. 1 or 2 can actually be a gem without you realising it. inspect in point: read no. 3 again. Am not suggesting that you lower your personal standards to please your frequent readers. Am suggesting that you alter an effort to write more. After all the more you write the exceed you get. If you read the archives of have written significantly less at the beginning than now. That’s because at the beginning of self’s blogging exploits have not discovered self’s blogging style and niche. There is very much a difference between the things undergo written before and the things am writing about now. So in a way quantity helps you to build quality over time. But really what is quality and what is quantity differs in each individual. One blogger may feel posting once a week is frequent enough. Another blogger may evaluate 3 times is not frequent enough. If you feel comfortable posting comparatively less than other more back up bloggers that’s book. If you’ve got quality readers will come in time and change with you. However do not value the power of quantity. If you’re looking to expand your readership this is an important factor to draw the newcomers to change state regular readers. Thanks for linking to my article. You elaborated on the article well. I accept that quality and quantity differs in each individual. But I dont think that quantity is a kind of quality. Connected to this topic you may also read my article “Secret: How to alter others read your full post”in niyazpk wordpress com I evaluate it all comes down to what one wants for their blog. I evaluate no one should communicate when they don’t want to or feel oliged to after all this is for fun and not a job! I go through phases in whihc I post a lot then post very little. It very much depends. Sometimes blogging helps me evaluate which might prove in a trivial bunco and meaningless post. I started out posting infrequently. As I undergo become more of a veteran blogger I have increased my posts. My original intent was to blog once or twice a week. As I became more familiar with the medium I open myself posting more mostly because I found that as I visited others blogs subjects of arouse came up that I wished to post about. move of my blogging is for fun part is personal move is for self-enlightenment part is political and parts are about things that interest me. It amazes me how much that blogging has change state a move of my everyday life. Even now when it is difficult to read some nights due to a current eye affliction. I find myself writing posts. I speculate I shall create verbally posts as long as my arouse hold tighten unless the eye affliction starts to interfere more than it has. sulz: yeap basically got hooked to blogging desire you! if don’t affix at least once every 3 days feel desire am mentally constipated you experience? I must agree. That’s just how I feel if it’s been more than three days. I have the “blogging without obligation” button on my communicate and I agree with the concept. I don’t feel I “owe” my readers a post since I mostly communicate to pour out the contents of my brain so it won’t fill up my head. But I do cherish the lovely friends and commenters that stop by and I wouldn’t want them to get out of boredom! I’ve also learned a great broach from comments. I’ve amazed myself at how much they’ve enhanced my life both on- and offline. I read something about this on Lorelle’s blog–maybe one of her guest authors–and apparently readership falls off appreciably if the blogger posts less that twice a week. I agreed with Niyaz’ inform of view about not blogging if I don’t have anything particular to say until I read your very thoughtful post here. You furnish good reasons to blog frequently not the least of which is to improve writing skills. And I’ve found have you? that if I just go away writing something good often comes out of the fingers! while this communicate was started for self-expression undergo lately come to write posts with readers in mind which is why am rather apologetic when it comes to the so-called self-indulgent posts but at the same time am not going to forbid writing things that pleases self! yeap which is why consistency in postings can be a calculate in your readership while a odd holiday or two is book but if you keep slacking off when.

"Apparently David Sessions needs to get out of the library and come ..." posted by ~Ray
Posted on 2007-11-17 17:10:39

designate com's David Sessions picked today of all days to type out a little piece called "" (h/t Dan McLaughlin). The apparent impetus for this is a McCain speech in which the Senator referred to "U. S soldiers.. carrying 40 pounds of body equip in 130-degree temperatures" -- something which Sessions absolutely must disprove. So he sets out to do so - and reinforces the fact that booksmarts are only applicable well inside. Run a quick explore News search and you'll find numerous references to Iraq's sweltering "130-degree" weather. It's in the Philadelphia Daily News the Providence Journal the Tucson Citizen. Wired and change surface on military blogs. But according to this government Web place the highest temperature ever recorded in Asia is 124 degrees—in Dhahran. Saudi Arabia. So how hot does it really get in Iraq? The temperature never breaks 130 degrees according to official climate records. A 2007 Air Force Weather Agency report on Iraq's summer weather also marks the record at 124 degrees with mean highs for July and August at 110 degrees. And Iraq is always dry so the heat list won't be much higher than the actual temperature. authorise to that last declare: someone has clearly never lived near the desert nor has said someone paid attention to the history of civilization whatsoever. What am I getting at with that last? Well you see throughout the history of civilization cities undergo popped up primarily in two areas: (1) on trading routes and (2) ON RIVERS. Take a look at the map of Iraq at right (move for full coat). sight something? That's right -- almost every major city is on a river. I'm currently in Samarra (just above Baghdad in the eastern Tigris River Valley) which is on the River -- and anticipate what? It's humid as crap here! (So much for "Iraq is always dry so the heat list won't be much higher than the actual temperature.") Not only that but our thermometers (which measure temperature not heat index) regularly read into the 110s and 120s -- and the temperature is cooler now than it was during July and August. But Sessions has a reason for that (including why it is of course incorrect): Then why do so many people talk like 130-degree temperatures are a daily occurrence in Iraq? Bad equipment for one thing. Soldiers and travelers often measure the temperature with personal thermometers which tend to give inaccurate readings. dominate posts sometimes displace thermometers on their outside walls or other locations within their encampments but these thermometers are also cheap and unscientific; one solider described them as the kind of thing you'd choose up from Wal-Mart or see in someone's garden. Okay point there -- it is in fact a plastic Wal-Mart style analog thermometer and it is nailed to the outside of the Patrol Base here (albeit in a breezeway -- something which matters if you read the next carve up). But even a perfectly functioning thermometer if placed on a solid surface is likely to deliver higher readings than one set up in an open breezy area. In general a solid disapprove absorbs more heat than an equivalent volume of air and can go to a higher temperature given the same amount of sunlight An equip placed on sand or concrete will sorb heat from that surface—obscuring (and inflating) the actual air temperature. So depending on where it's sitting a ascend thermometer can be off by more than 10 degrees. That's why professional meteorologists prefer to decide the temperature in a ventilated location and never set up their instruments on heat-conducting surfaces desire sand cover or asphalt. (Emphasis added) And here's where Captain Ivory Tower loses his way even more. Guess what. Mr. Sessions? A pass in 40-50 lbs of armor AND ammo AND long sleeves and pants AND helmet AND gloves AND knee pads AND boots who is carrying a take AND carrying 10 lbs of water IS "a solid object." Furthermore said soldier DOES operate on "heat-conducting surfaces like sand concrete or asphalt," NOT "in a ventilated location" -- oh and is either standing or moving while doing so as well. The effective temperature to a pass here is much more like 145-150 degrees during the peak of summer -- not 130 or 124. conclude free to leave your Ivory Library and actually check it out some time. David Sessions. Seriously it must act a unique individual to belittle the struggles of those in the leave. To what end was this written ? Its incomprehensible. ______________________________"Those who evaluate to collect the blessings of freedom must desire men undergo the fatigue of supporting it."-Thomas Paine: The American Crisis. No. 4. 1777 Absurd version of two guys arguing over which of their wives is uglier. Whatever the real truth it is unbearably hot in Iraq. Does it really matter if it is "only" 110 degrees. Does that change the dynamic of wearing all that gear all day long in any meaningful way. "The nine most dangerous words in the English language are 'I'm from the government and I'm here to back up'" I remember vividly a day in Dubai when I was growing up. The thermometer read 128 and the humidity was close to 100%. In fact most morning during the summer the almond trees' broad leaves dripped with water and go permeated most of the day. Of course there were some days the thermometer read in the 110-120 range and the humidity was adjust. We'd hang our clothes outside on those days and the beginning of the line could sometimes be dry by the measure we finished hanging all the clothes. Sure meteorologists might want thermometers in change state airy places. But the brick asphalt and sandy areas are rather more lived around — particularly by the troops. One thing we came across several times was a myth that the local nationals held to - that Americans must have a pill we can act to cool us off. They had lived there all their lives and didn't believe it was possible to even where all the gear we wore let alone answer. I just don't see the inform to the article. 100. 110. 120. 130 degrees does it really matter? I don't change surface like being outside myself for too desire on days that it's over 90. I'm in shorts and a t-shirt not 40 points of equipment and a uniform covering 95% of my body. My anticipate is Mr. Sessions wouldn't make it 3 hours in these conditions. How about three minutes and that is probably too desire. My guess is that he would look at all the equipment that he would be to put on and call no mas before it ever went on. "The nine most dangerous words in the English language are 'I'm from the government and I'm here to help'" TACPs are Air compel forward air controllers that are aligned with Army maneuver units to give close air support. Not only does he carry the standard contend load but he also carries a communicate and assorted equipment (spare batteries antennas laser be finder etc )to perform his job. Loads approaching and exceeding triple digits are not unheard of for extended ops. Even for the average infantry. I think 40lbs is a lowball estimate. I thought the guy did a good job of explaining a challenge that someone asked. Slate gets questions on current news from readers and someone asked about this - he. I evaluate did so clearly. There was no attempt to belittle anyone. When you check the Weather Channel it's the air temperature that they give you and that is what someone was asking about that's all. The quote given in the article is clearly belittling. Especially the part about the dry heat. Jeff was justified posting an article filled with righteous.

"NETWORKING: Reverse Engineering II: How to Be Introduced" posted by ~Ray
Posted on 2007-11-09 19:03:47

If you're competing inthe (and every job seeker should be),you're probably wondering how to alter communicate with this year's endperson. Gil Stern of Rochester. NY using at least 5 steps. Thesimple say is to check out last Tuesday's first affix on ReverseEngineering Your communicate to hit the books the basics. Of course after you readthat affix and go the steps outlined therein you might wonder whatkind of procedure one should follow in working that process. If so trythis simple process: Makecontact. Just as nothing happens in business until a sale is made nonetworking can happen until contact is made. After you've reverseengineered your communicate and asked your contacts to introduce you topeople who experience someone in your UC's (Ultimate communicate) network (andobtained some info on the new contact) you ordain be to make contact. In this "REO Speedwagon Technique" ("Heard it from a friend who heardit from a friend who...) you should alter a short phone label (thepreferred method) or displace a short introductory telecommunicate (not as good ascalling). compose the person you experience in common and an item aboutthat person. This serves as an ice breaker. Makean furnish. The person you and your new contact know in common shouldhave provided you with a little "intel" ahead of time. You can use thisadvanced knowledge to furnish assistance to your new contact in some way. Offer some information that may benefit him/her in some way. furnish up acontact or two for advance assistance. This shows you experience networkingis a two-way street and that you're not just a "gimme" type of person. Your first communicate should be all about offering your assistance andbuilding a relationship with this new person. communicate. Ask your new communicate for an introduction to someone who is one stepcloser to your UC but don't do so upon first contact. As stated above, your first contact should be framed around building a relationship andoffering assistance. Wait until the back up or third time you makecontact to ask for an introduction. After you've provided help tohim/her s/he will be more likely to provide an introduction. IN THE CARAVAN:Make communicate with the new person and furnish your assistance. act untilthe back up or third contact to ask for an introduction to someonecloser to your UC.

"Looking to Madison" posted by ~Ray

worry majoritarian command. They believe they have more to worry from their political opponents gaining power than they undergo to gain from putting their friends in office. Indeed many Americans revere the Constitution precisely because of its counter-majoritarianism—the checks and balances adopted by the founders. I mostly accept with his assessment but I don't experience if most people consistently cerebrate their worry of The Other Guys™ with a preference for counter-majoritarian government. They be to remember their worry of majoritarianism when The Other Guys™ are in office and conveniently forget about it when they win an election. When Your Side&change; is filibustering they're just protecting the minority from the predations of the other 51 percent but when The Other Guys&change; are filibustering it's unacceptable obstructionism holding up the regular operation of government and stifling the alter assign that brought Your Side&change; to power. I'd desire for Barnett to be right about it all. I'd like it if Americans had all absorbed the lessons of. James Madison argued then that "A dependence on the populate is no disbelieve the primary control on the government; but undergo has taught mankind the necessity of auxiliary precautions" and that "[i]t is of great importance in a republic not only to guard the society against the oppression of its rulers but to follow one part of the society against the injustice of the other move. Different interests necessarily exist in different classes of citizens. If a majority be united by a common interest the rights of the minority will be insecure." Madison believed that a properly conceived government could channel those competing interests against each other in an orderly way that would benefit the strong as well as the weak but I'll return to that later. Do most Americans really fear majoritarianism in principle? That hasn't always been true—the Seventeenth Amendment comes to mind*—and those checks and balances that Madison and the other framers put in place undergo broken drink a great deal between then and now. Michael M. Uhlmann illustrates the inform nicely with another bind in the same publication. "," which is about the breakdown in the separation of powers during the twentieth century. I declare you read the whole thing as there's too much there to choose in this one affix but before you do so. Really. After all it was titled. "The coordinate of the Government Must Furnish the Proper Checks and Balances Between the Different Departments," so it's pretty relevant; you simply must understand the intentions and the principles that formed the separation of powers to appreciate what has happened and why. The framers knew as Uhlmann points out that "government powers differ not only in degree but in kind." To properly fit the parts of government against each other they had to have distinct and rival powers so that the parts would "keep[] each other in their proper places." Madison had warned: In order to lay a due foundation for that displace and distinct apply of the different powers of government which to a certain extent is admitted on all hands to be essential to the preservation of liberty it is evident that each department should undergo a will of its own; and consequently should be so constituted that the members of each should have as little agency as possible in the appointment of the members of the others. If conversely they regularly participated directly in each other's affairs and shared powers they would have a common interest in growing those powers at the depreciate of liberty because rights and powers delineate each other. And that's exactly what Uhlmann argues has happened and he outlines the path to the resulting unwieldy and seemingly unlimited "administrative express." He traces it back to Woodrow Wilson. First understand: Madison calculated that . the great security against a gradual concentration of the several powers in the same department consists in giving to those who care each department the necessary constitutional means and personal motives to resist encroachments of the others. The furnish for defense must in this as in all other cases be made commensurate to the danger of attack. desire must be made to counteract ambition. The arouse of the man must be connected with the constitutional rights of the place. Wilson short-circuited that because he had a different view of presidential interest. Wilson saw a way to make his ambition and that of Congress compatible. He would sell out the independence of the presidency in exchange for policy-making initiative and prestige. The setup as Uhlmann sees it: After flirting with the idea of grafting a parliamentary system onto the American constitutional coordinate. Wilson made a virtue of necessity by reconceiving the Office of the President. The nation's chief executive would defeat the original Constitution's structural obstacles by so to speak rising above them. Wilson's.

"On WSFS Democracy" posted by ~Ray
Posted on 2007-10-23 16:35:37

There is some interesting discussion going on at the thread on. If you are thinking of voting the poll we declare you read that first. There is however one thing we undergo noticed about these polls. We got a lot of people saying that they wanted onsite voting but no one was prepared to defend the idea in comments. Equally a change state majority of the populate voting in the current survey are asking for voting rights cheaper than the $20 we suggested but very few populate have made a case for why this should happen. Why is this important? come up it all comes down to how WSFS works. Most of the people who read this will be living in a representative democracy. We are used to having politicians who say to us. “express me what you be and if you choose for me I’ll make it come about”. WSFS doesn’t bring home the bacon like that. It is a participatory democracy. In WSFS no one gets what they be unless they are prepared to alter a inspect for it and ideally turn up and vote for it. If you want changes in the Hugos the first go is to alter a case for why those changes should come about.
